Non-applicant (Cause Title is taken from Case Information System) For Applicant : Mr. Shailendra Dubey, Advocate For State : Mr. Pramod Shrivastava, Deputy Government Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 28.04.2025 1) This is the 6 th bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 221/2022 registered at Police Station Takhatpur, District Bilaspur, for the offence punishable under Section 20 (b) of the NDPS Act.
-2- 2) Learned counsel appearing for the applicant would submit that out of fifteen witnesses, only seven witnesses have been examined; they have not supported the prosecution case; the applicant is in jail since 22 May 2022; thus, he would pray to allow this bail application. 3) On the other hand, learned State counsel would oppose the submission made by counsel for the applicant and submit that the quantity of contraband is 220 kilograms of Ganja which was seized from a damaged house of the applicant; earlier, bail applications moved by the applicant have already been dismissed on merits by this Court; thus, no case is made out for grant of bail. 4) I have heard learned counsel for the parties and perused the case diary. 5) Taking into consideration the fact that evidence adduced by the prosecution witnesses cannot be appreciated while dealing with the application under Section 483 of the BNSS; further considering the quantity of the contraband; earlier bail applications were dismissed on merits; there is no change in the circumstance, no case is made out for grant of bail.
