4.
The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that total value of the gold misappropriated by the accused herein is Rs.32,48,000/- and the petitioner was a supervisor and he joined hands with other accused and taken away gold jewels and re-pledged it in the name of husbands of A2 and A3 and so far, no one is arrested and the investigation in this case is in preliminary stage. 5. Heard the learned counsel for the Intervenor. 6.I have gone through the FIR. Though it is stated that the petitioner herein has informed the defacto complainant that other accused involved in breach of trust and cheating, it is stated by the defacto complainant that he has also conducted separate audit and he arrived satisfaction that this petitioner joined hands with other accused and was involved in cheating. So far no one is arrested in this case. 7.This Court after considering the arguments earlier, granted Interim anticipatory bail to the petitioner to appear and participate in the enquiry so as to find out the manner in which the occurrence had taken place. CRL OP No. 26301 of 2025 8.The learned Government Advocate (Crl.Side) for the respondent police reported that the investigation revealed that all these persons have colluded each other and misappropriated the gold jewels and the petitioner is also a supervisor and he regularly given report to the owner of the shop that all the accounts are in order. However, on proper auditing, it revealed that huge amount of gold jewels have been misappropriated. 9. I have also gone through the FIR and other connected materials.
I am of the view that since the petitioner is a supervisor and he has been directed to oversee the entire branch affairs, and he has also submitted a regular report that all the accounts and other things are in order and now it revealed that there was suppression of various accounts statements, I am of the view that the petitioner is also involved in the offence and hence, granting anticipatory bail would hamper the investigation, hence the interim anticipatory bail was granted to the petitioner is hereby cancelled and the relief of bail is also dismissed. 02-12-2025 1/2 gbi https://www.mhc.tn.gov.in/judis
