HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6439 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J.
1. Herd Sri Sarvesh Kumar Verma, learned counsel for the petitioner as well as learned Standing Counsel for respondent 1 to 4.
2. In the light of proposed order notice to private respondent is dispensed with.
3. It has been submitted by learned counsel for the petitioner that in consolidation proceedings revision has been preferred by the petitioner being Case No. 0696 of 2025, where by means of order dated 09.10.2025, an order of status quo has been passed.
4. It seems that despite order of status quo, the Consolidation Officer has proceeded in Case No. 35 of 2025 and 49 of 2025 under Rule 109Ka(2) of the U.P. Consolidation of Holdings Act. In the present writ petition the petitioner has sought direction to the Consolidation Officer to decide his application dated 10.10.2025 and also to stay the proceedings of Case No. 35 of 2025 and 49 of 2025, under Rule 109Ka(2) of the Consolidation of Holdings Act, in compliance of order dated 09.10.2025, passed by the Deputy Director of Consolidation, Kheri.
5. This Court finds that the proceedings before the Consolidation Officer have not been stayed by the Deputy Director of Consolidation and there is no reason as to why the proceedings under Rule 109Ka(2) of the Conslolidation of Holdings Act be stayed by this Court. Only interim Versus Counsel for Petitioner(s) : Sarvesh Kumar Verma Counsel for Respondent(s) : C.S.C. Nageena .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Revenue, Lko. And Others .....Respondent(s)
protection granted to the petitioner is with regard to the property in dispute where order of status quo has been passed.
6. In the light of above, this Court do not see any reason to interfere in the proceedings before the Consolidation Officer, under Rule 109Ka(2) of the Consolidation of Holdings Act. The petitioner would have full opportunity to move appropriate application in revision or before the appropriate authority for redressal of his grievance raised in the present writ petition. Hence this Court see no ground for interference in the matter.
7. Subject to aforesaid observations, present writ petition stands dismissed. November 4, 2025 A. Verma A227 No. 6439 of 2025 2 (Alok Mathur,J.) Digitally signed by :- ANURAG VERMA High Court of Judicature at Allahabad, Lucknow Bench
