This is an application under Section 5 of the Limitation Act, 1963 seeking condonation of delay of 187 days in filing the application for restoration of WP(C) No.132/2019 which was dismissed for default on
08.04.2025.
It is not the case of the parties that provision of Limitation Act is applicable in the writ petition and hence, there is no requirement of filing any separate application seeking condonation of delay in preferring the restoration application.
The application, as such, requires no consideration and stands dismissed. However, despite dismissal of the condonation application, registry is directed to diarize the restoration application filed by the applicant and list the same for consideration.
With the above, this application stands disposed of.
