IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.9737 of 2025 Date of Decision: 17.6.2025 _____________________________________________________________________ Vijay Kumar ……...Petitioner Versus Himachal Pradesh State Electricity Board Ltd. and Ors. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Sarthak Mehta, Advocate. s For the respondents: Mr. Rajan Kahol and Mr. B.C. Verma, Additional Advocates General with Mr. Ravi Chauhan, Deputy Advocate General, for respondent No.1. Mr. Piyush Rathore, Advocate, for respondents No. 2 and 3. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Petitioner herein, who at present is working as Electrician (PHE) Bhabha Power House Division, HPSEBL, Bhabhanagar, District Kinnaur, Himachal Pradesh, has approached this Court in the instant proceedings, seeking direction to the respondents to consider and decide his pending representation (Annexure P-2), whereby he has sought transfer from the aforesaid station to one of the stations of his choice in terms of transfer policy, which enables an employee to seek transfer after completion of normal tenure of posting in hard/tribal area i.e. two winters and three summers. 2. Since petitioner has already completed the normal period in tribal area, he has approached the respondents by way of - 2 - representation (Annexure P-2), but since needful has not been done till date, petitioner is compelled to approach this Court in the instant proceedings. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Piyush Rathore, Advocate. Mr. Rathore, fairly states that pending representation, if not already decided, shall be decided expeditiously. 4. Consequently, in view of the above, this Court without going into the merits of the case deems it fit to dispose of the present petition with a direction to the respondents/competent authority to consider and decide his representation (Annexure P-2), expeditiously, preferably, within a period of ten days. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order taking note of the transfer policy, which certainly enables an employee to seek transfer from hard/tribal area to station of his/her choice after completion of normal tenure. Pending applications, if any, also stand disposed of. June 17, 2025 (Sandeep Sharma), (manjit) Judge
