HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 11303 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that the applicant has already been granted bail in this case under Section 64(1) BNS and Section 3/4 of the POCSO Act by a coordinate Bench of this Court, as reflected in Annexure No. 2 to the bail application. It is further stated that during the course of investigation, Section 351(3) BNS has been added, and the applicant now seeks bail in respect of the newly added section. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA has opposed the bail application. In view of the earlier bail order passed in favour of the applicant under Section 64(1) BNS and Section 3/4 of the POCSO Act, and considering that the present bail application pertains to the added section, as well as the fact that the applicant is in custody since 24.04.2025 and has no criminal antecedents, I am of the opinion that this is a fit case for granting bail to the applicant. Accordingly, the bail application is allowed. Versus Counsel for Applicant(s) : Iqbal Ali Counsel for Opposite Party(s) : G.A. Kamil .....Applicant(s) State Of U.P. Thru. Prin. Secy.
