HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12352 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicants and learned A.G.A. for the State as well as perused the record.
The accused-applicants Chetram @ Rishu and Ramgopal seek bail in Range Case No.08 of 2025-26 under Section 9, 48(A), 51(1) Wild Life Protection Act, Police Station Majhagai, District Lakhimpur Kheri.
Learned counsel for the applicants submits that the applicants have been falsely implicated in this case. The alleged recovery of 1kg meat is false. There is no independent witness to the recovery. The offence is triable by Magistrate. The applicants are in jail since 25.9.2025.
It is further submitted that the co-accused Surendra Singh, who was also arrested from the spot, has been granted bail vide order dated 17.11.2025 passed in Bail Application No. 10884 of 2025 (Annexure- 3 to the bail application). The applicant seeks parity with the bail
order of the said co-accused.
It is further submitted that there is no possibility of the applicants fleeing away after being released on bail or tampering with the witnesses. In case the applicants are enlarged on bail, they shall not misuse the liberty of bail.
Learned A.G.A. though has opposed the bail prayer of the applicants but could not dispute that it is a case of parity. Versus Counsel for Applicant(s) : Santosh Kumar Kanaujia Counsel for Opposite Party(s) : G.A. Chetram Alias Rishu And Another .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s)
I have considered the arguments advanced by learned counsel for the parties as well as perused the record.
On due consideration to the facts that the applicants are in jail since 25.9.2025, they have no criminal antecedents, the offence is triable by Magistrate, there is no independent witness to the recovery, so also considering the ground of parity with the bail order of co-accused Surendra Singh and without expressing any opinion on merits of the case, I find it to be a fit case for enlarging the applicants on bail.
Accordingly, the bail application is allowed.
Let the applicants Chetram @ Rishu and Ramgopal be released on bail in aforesaid case crime number subject to their furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the court below concerned with the following conditions:
(i) The applicants will not tamper with the evidence during the trial.
(ii) The applicants will not pressurize/intimidate the prosecution witnesses. They shall cooperate in the trial.
(iii) Any other condition which the trial court may deem fit and proper may also be imposed.
It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
