Deb, learned Legal Aid Counsel for the applicant, who has submitted that the applicant has preferred an appeal against the 2025:MLHC:1104 2 impugned judgment dated 28.07.2021 and the related sentence dated 05.08.2021 passed by the Court of the learned Special Judge (POCSO), Ri- Bhoi District, Nongpoh in Spl. (POCSO) Case No. 8 of 2015. 2. However, while preferring the appeal, a delay of 1623 days has occurred, the fact being that the applicant is not in a position to prefer the appeal for the reasons that he is financially unsound, and also that he is not conversant with the procedure. It was only after a legal aid was accorded to him that he has decided to prefer the appeal. It is prayed that the delay may be condoned and the appeal be heard on merits. 3. Mr. H. Kharmih, learned Addl. PP appearing on behalf of the State respondent has no objection to the prayer made. 4. On consideration of the submission made by the learned counsels, this Court is inclined to allow this application. Accordingly, the delay of 1623 days in filing the related appeal is hereby condoned. 5. Misc. Case disposed of. 6. Registry to diarize the appeal and list it for admission after 1(one) week.
