This Contempt petition has been preferred by the applicant under Article 215 of the Constitution of India read with Section 12 of the Contempt of Courts Act,1971 for non-compliance of the order dated 05.08.2024 passed in WP(C) No.3949/2024. 2. Vide order dated 05.08.2024 (Annexure-C/1) passed in WP(C) No.3949/2024, this Court has stayed the effect and operation of the order dated 16.10.2023 passed by the Deputy Registrar Cooperative Societies, Rajnandgaon (C.G.). 3. Learned counsel for the applicant would submit that this Court has passed the aforesaid order, whereby effect and operation of order dated 16.10.2023 2 has been stayed, despite that, respondent authorities are proceeding to recover the amount from the applicant. 4. When specific question was posed to the counsel for the applicant that whether he has filed any document to demonstrate the fact that respondent authorities or any other authority are disobeying the stay order or not, then he submitted that he has not filed any such document, which demonstrate the aforesaid fact. 5. Having considered the fact that, applicant has not filed any document to demonstrate said fact that respondent authorities are disobeying the order dated 05.08.2024 passed by this Court in WPC No.3949/2024. Thus, no case of contempt is made, as such I do not find any reason to proceed further in the matter, initiating contempt proceeding against the respondent. 6. However, liberty is left with the applicant to file fresh contempt petition, if any authority disobeys the order dated 05.08.2024 passed in WPC No.3949/2024. 7. Accordingly, contempt case is dropped.
