1. By the present Writ Petition, the Petitioner is questioning the order dated RAHUL JHA Digitally signed by RAHUL JHA Date: 2025.04.15 10:34:59 +0530
2 03/04/2025 (Annexure-P/1) whereby the petitioner has been transferred from Government Ayurved Aushdhalaya, Marra, District Durg to Ayush Wing, District Ayurved Hospital, Bastar, District Bastar. The petitioner is also questioning the order dated 04/04/2025, whereby he has been relieved from his present place of posting.

Learned counsel for the petitioner submits the impugned transfer order has been passed by the respondents’ authorities without considering he petitioner is a heart patient who under went Angioplasty which require continuous follow up and monitoring and posting to him far remote place would make it difficult for him to face any emergent situation. He would also submit that the petitioner had earlier rendered services in scheduled area for 4 years from 2010 to 2014, whereas there are several employees in the department who had never remained posted at Scheduled are are being exempted from such posting without any reason.

Learned Counsel for the State would submit that the State Govt. has constituted a Committee on 03/03/2025 for redressal of the grievances of the employees who have been transferred, as such, the grievance of the petitioner can be redressed by the Committee, if the petitioner will approach before the Committee within a stipulated period.
4. I have heard learned counsel for the parties and perused the pleadings as well as the order dated 03/03/2025 by which the Committee to redress the grievance of the employees has been constituted by the State Govt.
5. Looking to the ground taken by the petitioner in the petition, the Writ
3 Petition is disposed of with a direction to the petitioner to approach before the Committee constituted vide order dated 03/03/2025 within a period of 10 days and in case of filing a representation raising all the grounds/grievance made herein before the Committee, the Committee is
directed to consider the grievance of the petitioner after affording an opportunity of hearing and passed a detailed & speaking order in accordance with the Transfer Policy of the State Govt. within a further period of 25 days from the date of receipt of the representation by the petitioner. Till the decision of the Committee on the representation to be made by the petitioner, the effect and operation of 03/04/2025 (Annexure-P/1) and order dated 04/04/2025 (Annexure-P/2) shall remain stayed.
6. With the aforesaid directions, the Writ Petition stands disposed of.
