Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record. The instant criminal appeal has been filed seeking following main relief (s) :- "Wherefore it is most respectfully prayed that this Hon'ble court may graciously be pleased to set-aside quash the impugned bail rejection order dated 29.05.2024 passed by the court of Learned Special Judge SC/ST act. District Gonda, in bail application no. 1022/2024 (Sonu @ Mo. Jakir Vs State) in case crime no. 349/2023, under section 363,366,376,323,506 I.P.C. & 3(1) (DA)(DHA), 3(2) (V) SC/ST ACT. Police station Dhanepur, District- Gonda, and enlarge/release the appellant/accused on bail in the aforesaid case crime, during the trial, in the interest of justice." On account of some formal defects crept in the appeal, learned counsel for the appellant prays for withdrawal of the present appeal with liberty to the appellant to file afresh with proper pleadings and documents in support thereof. The aforesaid has not been opposed. In view of the above, the instant criminal appeal is dismissed as withdrawn with liberty as prayed for. Office is directed to return certified/original copies of the documents annexed with the appeal to the learned counsel for the appellant as per rules.
