[2025:RJ-JP:23311] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 5751/2025 Sapna W/o Sitaram, Aged About 37 Years, R/o Village Palka, Police Station Sikri, District Deeg (Rajasthan) (At Present Confined In District Jail, Bharatpur). ----Petitioner Versus State of Rajasthan through PP ----Respondent For Petitioner(s) : Mr. Girish Khandelwal For Respondent(s) : Mr. Amit Kumar Gupta, AGA-cum-PP Ms. Manju Dave, AGA HON'BLE MR. JUSTICE MANEESH SHARMA (V. J.) Order 17/06/2025 1. The instant bail application has been filed under Section 483 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (B.N.S.S.) on behalf of the petitioner. The petitioner has been arrested in connection with FIR No.404/2023 registered at Police Station Sikri, District Deeg for the offence under Section 306 of Indian Penal Code, 1860 (I.P.C.). After investigation, charge-sheet has been filed for the offence under Section 306 of IPC. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in these cases. He submits that the marriage of the petitioner and the deceased was solemnized around 15 years ago, the petitioner is a lady of 37 years of age and is in judicial custody since 07.03.2025. He further submits that in the suicide note, the deceased has not levelled allegations against the petitioner at hand, and has named the other co- accused persons namely Shyam and Suresh. He further contended [2025:RJ-JP:23311] (2 of 2) [CRLMB-5751/2025] that the charge-sheet has already been filed in this matter and trial of the case may take considerable time, therefore, the bail application of the petitioner may be allowed. 3. Learned Additional Government Advocate vehemently opposes the bail application. 4. Heard and perused the material available on record. 5. Considering the fact that the petitioner is a lady of 37 years of age and, in the suicide note, the deceased has not levelled allegations against the petitioner at hand, and has named the other co-accused persons namely Shyam and Suresh. The trial of the case may take considerable time, and also considering the fact that the charge-sheet has already been filed in this matter, therefore, without commenting anything on the merits/demerits of the case, I deem it just and proper to enlarge the petitioner on bail. 6. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioner- Sapna W/o Sitaram, shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned Trial Court for her appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
