Petitioner herein, who at present is working as Lecturer (Computer Science) at Government Senior Secondary School Singla, Rampur Bushahr, District Shimla, Himachal Pradesh, is aggrieved of impugned transfer order dated 6.6.2025, whereby he has been transferred from afore school to GSSS Sainj, District Shimla, Himachal Pradesh on account of the fact that there is zero enrolment in the subject of Computer Science in the afore school. 2. Precisely, the grouse of the petitioner, as has been highlighted in the petition and further canvassed by learned counsel for the petitioner is that thought there are two students studying in the discipline of Computer Science as has been certified by the Principal of School concerned (Annexure P-3), but yet on the ground
- 2 - that there is zero enrolment in the school of the afore subject, he has been transferred. 3. While making this court peruse certificate dated 10.6.2025, issued (Annexure P-3), learned counsel for the petitioner attempted to argue that two students namely Aryan Gautam and Karan are studying in Classes 9 and 10 respectively, as optional subject i.e. Computer Science and as such, petitioner has been wrongly transferred on the premise that there is zero enrollment. 4. Pursuant to notices issued in the instant proceedings, Director of School Education, has come present. He states that bare perusal of certificate adduced on record by the petitioner itself suggests that only two students are studying in 9th and 10th class respectively and they have taken optional subject of Computer Science, but since petitioner is working as Lecturer, he otherwise cannot teach such students, rather they shall be taught by TGT (Non- Medical) or expert in the subject. He further states that number of schools where strength of the students is very high, but adequate number of lecturers are not present.
He further states that as per record made available to him, there are number of schools, where there is no requirement of lecturers, but yet on one pretext or the other, they are working there and drawing handsome salary for no work. - 3 -

Since it is not in dispute that petitioner has already completed more than two years and five months at present place of posting coupled with the fact that he being Lecturer is not required to teach the students of 9th and 10th standards, there appears to be no justification to interfere in the impugned transfer order and as such, same is upheld. 6. Consequently, in view of the above, present petition is dismissed. Officer present in the Court undertakes that adequate arrangements for teaching the subject of Computer Science, if not available in the afore school, shall be made expeditiously. Interim order, if any, stands vacated. All pending applications stand disposed of accordingly. June 24, 2025
