Heard learned Counsel for the petitioner, Sri Varun Pandey, learned Counsel appearing on behalf of the respondent nos.2 and 3 and learned Standing Counsel appearing on behalf of the respondent nos.1, 4 and 5. 2. This petition has been filed with the following main prayer:- "Issue writ, order of direction in the nature of the mandamus whereby directing the opposite parties specifically to the opposite party no.3, to make renewal of the passport of the petitioner baring Passport No. P 3025441 is going to expired on 10.08.2026." 3. It has been submitted by learned Counsel for the petitioner that the petitioner is residing in Kuwait and he has asked his brother to file this petition on his behalf. A copy of the letter issued by the petitioner to his brother has been filed along with Vakalatnama. 4. Sri Varun Pandey, learned Counsel for the respondents, has raised a preliminary objection regarding maintainability of the petition. He says that no Power of Attorney has been executed by the petitioner in favour of his brother. 5. It has also been pointed out that the petitioner has submitted his reply Versus Counsel for Petitioner(s) : Anand Kumar Yadav Counsel for Respondent(s) : C.S.C., A.S.G.I. Mohd. Salman .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Lko. And 4 Others .....Respondent(s) to the show cause notice issued to him, but such reply has to be decided by the Embassy in Kuwait and not by the Regional Passport Officer, Lucknow. So this petition has been filed at a place without jurisdiction. 6. This petition is disposed of with a direction to the petitioner to approach the Embassy concerned at Kuwait.
