Heard Sri Kuldeep Kumar Kalhans, learned counsel for the applicant as also the learned Addl. Government Advocate. By way of this application the applicant has prayed for a direction to the learned court of learned Judicial Magistrate-II, Gonda, to decide the Criminal Case No.128/ 2013, Patta Devi Vs Sunil Kumar and others, Police Station Kotwali Nagar, District Gonda, expeditiously withing stipulated period as fixed by this Hon'ble Court. Learned counsel for the applicant has submitted that the aforesaid case is pending since 2013 without any substantial progress. He prays for expeditious disposal of the same. Learned A.G.A. has no objection on the prayer made by the learned counsel for the applicant and submits that a positive direction be given to the trial court to decide the case of the applicant, as merely keeping pending the same by the trial court does not suffice any purpose of the litigation. In view of the statements made by the learned counsel for the parties, as the said case is of 2023, the trial court is directed to decide the aforesaid case expeditiously, without granting any unnecessary adjournment to either of the parties, from the date of filing of the certified copy of this order, unless there is some legal impediment or unless there is any order Versus Counsel for Applicant(s) : Kuldeep Singh Kalhans Counsel for Opposite Party(s) : G.A.
