(2) Petitioner is resident of Village Kanakpur, Tehsil Kaladhungi, District Nainital. According to him, he is covered by government policy, which provides for regularisation of unauthorised occupation over Category IV land in favour of occupants. Earlier, he filed a writ petition, which was disposed of on 17.3.2021 with a direction to District Magistrate to consider petitioner’s application within ten days. District Magistrate thereafter passed an order on 30.7.2021 asking the petitioner to submit all documents and necessary fee. Petitioner was also directed to give details of the land, which was in possession of his daughter-in-law. (3) Learned Senior Counsel for the petitioner subm its that everything has been done by the petitioner in term s of District Magistrate’s order dated 30.7.2021. He submits that matter is hanging in a balance, even though petitioner has deposited the fee also. (4) Having regard to the facts of the case, writ petition is disposed of with a direction to District Magistrate to examine the claim of petitioner in terms of the government policy and if he is found entitled to regularisation of his 2025:UHC:11006 unauthorised possession of Category 4 land, then necessary order shall be passed by District Magistrate within ten weeks from the date of presentation of certified copy of this order.
