[2025:RJ-JP:29377] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 5784/2025 Jhabbar Singh @ J.P. S/o Pabudan Singh, R/o Ward No. 10, Nangli Saledi Singh, Police Station Khetrinagar, District Jhunjhunu, Rajasthan. (At Present Confined In District Jail Jhunjhunu). ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Gajendra Singh Rathore For Respondent(s) For Complainant(s) : : Mr. Naresh Kumar Gupta, PP Mr. Dharam Veer Tholia HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 01/08/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0014/2025 registered at Police Station-Khetri Nagar, District-Neem Ka Thana for the offences under Sections 316(2), 324(2), 351(2) and 331(6) of BNS. 2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The petitioner is not named in the FIR. The FIR has been lodged after a delay of sixteen days and no injury has been caused to any one. He further submits that the main accused-Narendra Singh, who has been named in the FIR, has already been released on anticipatory bail [2025:RJ-JP:29377] (2 of 3) [CRLMB-5784/2025] by the Co-ordinate Bench of this Court on 12.03.2025. He again submits that the petitioner is behind the Bars since 03.05.2025 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. Learned counsel for the complainant has submitted that it is wrong that the FIR is lodged with a delay of sixteen days. On the day of incident, information has been given to the concerned Police Station on which the person Anil Kumar was arrested. He further submits that complainant is getting regular threat by the petitioner and therefore complainant has obtained the protection order by the Hon’ble High Court, hence the bail application of the petitioner may be rejected. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submissions and material available on record and deliberating all the facts and circumstances of the case, especially the fact that the co-accused has been released on bail by the Co-ordinate Bench and the petitioner is not named in the FIR and custody period of the petitioner but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 7. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Jhabbar Singh @ [2025:RJ-JP:29377] (3 of 3) [CRLMB-5784/2025] Jp S/o Pabudan Singh shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
