01. 1. Heard learned counsels for the respective parties. 2. Instant petition is filed for release of the petitioner on bail in connection with G.R. Case No.417 of 2024 arising out of Pipili P.S. Case No.239 of 2024 pending in the file of learned J.M.F.C, Pipili on the grounds stated therein. 3. In course of hearing, learned counsel for the petitioner submits that the petitioner after being arrested in the present case was remanded in two more and he is in custody from 20th January,
2025. It is submitted that there has been seizure of cash from the co- accused persons. Mr. Acharya, learned ASC for the State informs the Court that an amount of Rs.15,000/- is also seized from the petitioner besides a ‘bhujli’. It is further informed to the Court that the preliminary chargesheet was filed in 2024 showing the petitioner as an absconder and thereafter, he has been arrested. The final chargesheet is not yet filed since another co-accused is yet to be arrested. Recorded the objection of Mr. Acharya, learned ASC for the State against release of the petitioner in view of the alleged mischief committed and the antecedent, he is having with. Considering the above facts and submission of learned counsel for
the respective parties, under the impression that there is substantial progress in the further investigation and the fact that preliminary chargesheet is filed vis-à-vis the present accused, who is in custody since arrested and in the meantime, the co-accused, namely, Ashis Behera is on bail vide BLAPL No.9921 of 2024 dated 29th October, 2024, the Court is inclined to allow him to be released on similar conditions. 4. Accordingly, it is ordered. 5. In the result, the petition stands allowed.
As a necessary corollary, the petitioner is directed to be released on bail in connection with G.R. Case No.417 of 2024 arising out of Pipili P.S. Case No.239 of 2024 subject to him furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with two solvent sureties for the like amount each to the satisfaction of the learned J.M.F.C, Pipili, who shall impose such other conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall not involve himself in similar criminal activities after being released and co-operate in the investigation and make himself physically available as and when required. 6. The BLAPL is disposed of. 7. Urgent certified copy of this order be granted as per rules. (R.K. Pattanaik) Judge
