Heard Mr.M.Hemchandra, learned senior counsel assisted by Mr.Juno Rahman, learned counsel for the petitioners and Mr.H.Devendra, learned Dy.A.G, Manipur assisted by Mr.Bheigya Meitei, learned Jr.Govt counsel on behalf of the State respondents. [2] The petitioners are occupiers of their lands bearing patta No.455/456 (old), 596/1905 (new) covered by C.S.Dag No.1425/1826 measuring an area of .193 acres located at 27- Wangkhei Nongpok, Imphal East District Manipur and patta No.455/456 (old), 569/1907 (new) covered by CS Dag No.1257/1422 measuring an area of .194 acres located at 27 Wangkhei Nongpok, Imphal East District, Manipur. It is stated that recently, the D.C., Imphal East issued Appeal dated 20.07.2025 informing all the unauthorised occupiers of land to remove the unauthorised structures failing which Government will initiate eviction drive and vide another letter of the Sub Divisional Officer, Porompat addressed to the Deputy Commissioner, Imphal East, request has been made for making necessary arrangement and in the schedule of eviction, the petitioners lands fall at Sl.No.10 Andro Parking to Meihoubam Lampak lizard Library and the same was to be evicted on 14.8.2025. It is prayed that eviction if any, over the public land be done strictly after verifying proper verification and demarcation. [3] Mr.H.Devendra, learned Dy. A.G, Manipur submits that the State Government has initiated a mass movement for eviction of encroachers from Government land and till now none has been evicted from their private lands and no eviction is done within patta lands. [4] Mr.M.Hemchandra, learned senior counsel for the petitioners submits that in that case, the State respondents be directed to verify the extent of encroachment, if any, by the petitioners and petitioners may be allowed to remove any structures from the land so encroached. [5] Recording the submissions made at the Bar and in the nature of relief sought for in the writ petition, this Court is of the opinion that the writ petition can be disposed of at this stage by directing the State respondents to verify the possession of the petitioners and only after proper verification, eviction and demolition from the portion so encroached may be carried out. With the observation, the writ petition is disposed of. Misc case is also closed. It is made clear that this Court does not express any opinion on the merit of the case. Furnish a copy of this order to learned counsel for the parties in the course of the day.
