According to the petitioner, certain villagers have encroached upon public road in Village Noorpur Panjanhedi, District Haridwar and the concerned authorities have turned a blind eye to such encroachments. 4. By means of this writ petition, petitioner has sought the following reliefs: - “Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent no. 2 & 3 to remove the encroachment from the public road/ Government Road in Khasra no. 113 area 0.0990 hectare, in Village Noorpur Panjanhedi, Tehsil & District Haridwar within a stipulated time period as this Hon’ble Court may deem fit and proper. ii. Issue a writ, order, or direction appropriate in the nature to initiate departmental action against erring revenue officials responsible for non-compliance of lawful orders dated 02.05.2025 and 25.06.2025.” 5. Learned State Counsel submits that Tehsildar, Haridwar has constituted a committee consisting of three revenue officials, which will have the spot inspected and take necessary measures. He submits that since the extent of 2025:UHC:11335 encroachment is large, therefore, police force would also be needed for survey/ inspection. 6. The writ petition is disposed of with a direction to the District Magistrate to constitute a team of officers consisting of an officer not below the rank of Tehsildar. Other members of the team would be Survey Naib Tehsildar and SHO of the concerned police station. The said team shall visit the site and after survey submit its report. Based on such report, necessary steps shall be taken by the District Magistrate within nine months, to ensure that the road is cleared of all encroachment.
