HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 4780 of 2024 Court No. - 8 HON'BLE MANISH KUMAR, J. The present contempt application has been preferred against the alleged non compliance of the interim order dated 29.10.2012 whereby the writ Court has
directed for maintaining status quo as it existed then.
Learned counsel for the applicant has submitted that during the pendency of the writ petition and the existence of the interim order of status-quo, the respondents have executed three agreements to sell on 08.01.2020 & 20.06.2024 respectively which is nothing but a wilful and intentional disobedience of the order passed in the writ petition. On the other hand, learned counsel for the respondents has submitted that the affidavits of compliance have been filed by all the respondents individually enclosing therein the cancellation of agreements to sell with an undertaking that they will maintain the status quo as directed in the writ petition. He has further submitted that during the pendency of the present contempt application, the respondent no. 10 has expired and in his place, his wife, a signatory to the document by which the agreement to sell has been cancelled, being legal heir.
Learned counsel for the applicant has very fairly submitted that the agreements to sell has been cancelled. After hearing learned counsel for the parties and going through the record of the case, it is found that the respondents have rectified their mistake by cancelling the agreements to sell executed by them and gave an undertaking before this Court through their counsel that they will maintain the status quo as an interim order passed in the writ petition. In view of the submissions made by learned counsel for the parties and as per the undertaking given by the respondents through their counsel, nothing remains to be adjudicated in the present contempt application, as such, the same is dismissed.
