Also heard Ms. S.H. Bora, learned Additional Public Prosecutor for the State. 2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the Page No.# 2/3 accused/petitioner in connection with Sapatgram P.S. Case No. 36/2025 u/s 303(2)/318(4)/317(2)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023. 3. The allegations in a gist were that burmese areca nuts were carried in a vehicle without proper documentation and licenses and they were accordingly seized. The present petitioner claims to be owner of the said materials and it is contended on his behalf by the learned counsel for the petitioner that they were carried in a legitimate manner with proper documentation. In this regard, various invoices, E-Way bills including tax invoices have also been annexed with the bail petition. 4. On 12.08.2025, the petitioner herein was granted interim bail pursuant to which he stated to have been appeared before the I.O and the same is confirmed by Ms. S.H. Bora, learned Additional Public Prosecutor for the State. 5. It is submitted by the learned counsel for the petitioner that the chemical analysis report of the alleged contraband has also been received and it indicates that it contains ingredients which are of the local nature. The said FSL report is also available in the case diary. Placing an order of the learned JMFC, Bilasipara, it is submitted by the learned counsel for the petitioner that the interim custody of the bags of dried areca nuts were given to the present petitioner. 6. In the given facts and circumstances, the interim bail granted to the petitioner vide order dated 12.08.2025 is hereby Page No.# 3/3 made absolute subject to the conditions : i) That the petitioner shall co-operate with the remaining investigation ; ii) That the petitioner shall not hamper or tamper with evidence. 7.
