June 24, 2025 24 ARDR (Rejected) CRM (DB) 1135 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Debra Police Station Case No. 51 of 2024 dated 27/1/2024 under Sections 302/201 of the Indian Penal Code. And In Re : Dhananjay Bar Dolai @ Dhananjoy Bar Dolai ... Petitioner. Adv. Siddhartha Sarkar ... for the petitioner. Adv. Sonali Das, Adv. Jonaki Saha, …for the State. Learned counsel for the petitioner submits that the petitioner is innocent and is in custody for about 215 days. The case is based on circumstantial evidence. Charge sheet has been submitted. His further detention is not required and he prays for bail. Learned counsel for the State opposes the prayer. I have considered the material on record. The victim was last seen together with the petitioner on the date of occurrence. Offending weapon has been recovered at the instance of the petitioner. There are post occurrence witnesses who have implicated the petitioner in the alleged crime. Considering the gravity of the offence and prima facie involvement of the petitioner therein, his prayer for bail is rejected at this stage. The application for bail is disposed of. Case Diary be returned. 2 Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
