Mr. Siddhartha Singh, learned counsel for the appellants. 2. Mr. Ajay Veer Pundir, learned counsel for the respondent through V.C. 3. Both the parties Mr. Mahmood Hasan and Shiv Kumar are present in court and their respective counsel identified both of them through Aadhar card and both of them also submits they have settled their dispute by way of entering with the compromise on 14.12.2025. 4. The instant second appeal has been preferred against the judgment and decree dated 15.07.2004 passed by learned Civil Judge (J.D.), Roorkee, Haridwar, in O.S. No. 43 of 1993 ‘Mahmood Hasan vs. Mahaveer and Others’ as well as against the judgment and decree dated 08.01.2010 passed by the Additional District Judge, 1st FTC, Roorkee, Haridwar in Civil Appeal No. 3 of 2004 ‘Mahaveer and Others vs. Mahmood Hasan’ 5. On the previous date the statement was made that the parties have settled their disputes and now the compromise entered in between the parties has been placed on record along with IA12541 of 2025, wherein, separate affidavits of the parties have also been filed and the same is taken on record. 6. Mr. Siddhartha Singh, learned counsel for the appellant and Mr. Ajay Veer Pundir, learned counsel for the respondent through V.C. also submits that the parties have entered into the compromise, therefore, the instant second appeal be disposed of in terms of the compromise dated 14.12.2025. 7. In such view of the matter and particularly taking into consideration that the parties have entered with their compromise, the instant second appeal is disposed of in terms of the compromise. The judgment and decree passed by both the 2025:UHC:11333 courts are set aside and fresh decree be prepared in terms of compromise by treating compromise dated 14.12.2025 be the part of decree.
