1. Heard Mr. R. Bora, learned counsel for the petitioner. Also heard Mr. D.P Goswami, learned Additional Public Prosecutor for the State. 2. By this petition under Section 482 BNSS, is filed for granting
Page No.# 2/3 the privilege of pre-arrest bail to the petitioner, namely, Uttam Chauhan @ Uttam Kumar Chauhan apprehending his arrest in connection with Kheroni P.S. Case No. 31/2025 registered u/s 105/3(5) of BNS, 2023. 3. It is alleged by the informant/father of disease that his 28 year son, Uttam Chauhan was called by two accused to one area where he took psychotropic substance with them and subsequently, he died. 4. It is submitted by the learned counsel for the petitioner that pursuant to grant of interim vide order dated 08.08.2025, the petitioner appeared before the I.O and his statement was recorded. The same is confirmed by the learned Additional Public Prosecutor for the State, who based on the contents of the case diary submits that investigation materials lends support to the story alleged in the FIR about the persons taking narcotic drugs together and then subsequently, the informant’s son met with his death. 5. The PM report is available but final opinion regarding death is pending, for receipt of chemical analysis report. It is submitted that there is progress in the investigation, but investigation is also pending for receipt of the FSL report. 6. In the circumstances, I do not deem it necessary to cancel the interim bail and accordingly, the interim bail granted vide order dated 08.08.2025 is hereby made absolute subject to the conditions : i) That the petitioner shall co-operate with the remaining investigation ;
Page No.# 3/3 ii) That the petitioner shall not shall not intimidate or harass the informant or his family; iii) That the petitioner shall not hamper or tamper with evidence. 7. Return back the case diary. 8.
