Neutral Citation No. - 2025:AHC:80356 Court No. - 33 Case :- WRIT - C No. - 3840 of 2025 Petitioner :- Anju Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Sudhanshu Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J. 1. The order dated 10.01.2025 passed by respondent no. 2/District Magistrate, Kanpur Dehat, is under challenge in the present petition. 2. Facts in brief as contained in the present petition are that after the removal of the sitting Pradhan of the village. Thereafter, a three members committee was constituted to conduct the bank accounts of the Village Panchayat, Raraonkh, Khanpur Dilwal, Sandalpur, District Kanpur Dehat. The aforesaid action was taken due to removal of the regular Gram Pradhan. The complaints were made against one of the member of the aforesaid committee i.e. the present petitioner by various persons. 3. Pursuant to the aforesaid a show cause notice was issued to the petitioner by the respondent no. 3 on 14.11.2024, a detailed reply was submitted by the petitioner in response to the same on 20.11.2024, subsequent to the same a decision has been taken by the respondent no. 3 to remove the petitioner from the aforesaid committee and in her place one Sri Mulayam Singh who is also a member of the Gram Pradhan was nominated. 4. It is argued by the counsel for the petitioner that Mulayam Singh who was nominated as a member of the aforesaid three members committee is one of the complainant. It is further argued that in response to the show cause notice a detailed reply has been submitted by the petitioner but the same was not at all taken into consideration before passing the impugned order. 5. Heard counsel for the parties and perused the record. 6. After perusal it is clear that the order has been passed without taken into consideration the reply submitted by the petitioner which is a violation of principle of natural justice. 7. In this view of the matter, the present petition is disposed of directing the the Respondent no. 3/District Panchayat Raj Officer, Kanpur Dehat to pass a fresh order taking into consideration the reply submitted by the petitioner expeditiously and preferably within a period of six weeks from today. 8. The Order dated 10.01.2025 will be subject to the final decision taken in the matter by the respondent no. 3. 9.
