HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7671 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Counter affidavit filed today is taken on record. 2. Heard learned counsel for the applicant as well as learned A.G.A. and perused the record. 3. The applicant seeks enlargement on bail in FIR No.292 of 2024, under Sections 103(1) of BNS, Police Station Ghunghter, District Barabanki. 4. In terms of the FIR lodged through an application under Section 173(4) of the BNSS on 01.12.2024, it was alleged that the son of the informant sold certain parts of the land and he was in possession of the money, which was the sale consideration and subsequently, some amount was lend to one Umakant. It was stated that subsequently, an information was received that Umakant had died on 23.09.2024 and a postmortem was conducted of his body. The informant was informed by one Vishram and Ram Bhajan that the applicant had called the deceased for giving back the money and thereafter offered some liquor in which certain things were added because of which he died. The cause of death as per the postmortem report is ante mortem poisoning. No injury was noticed on the body of the deceased. 5. The Counsel for the applicant argues that subsequently, the said two persons, namely, Vishram and Ram Bhajan have not supported the prosecution and stated that they have never informed the informant as Versus Counsel for Applicant(s) : Ashok Kumar Singh, Ashish Kumar Tiwari Counsel for Opposite Party(s) : G.A. Ram Milan .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s) recorded in the FIR. 6. Learned A.G.A. vehemently opposed the bail prayer. 7. Considering the fact that the FIR was lodged based upon the apprehension and there being nothing to link the applicant with the act of administering poison coupled with the fact that the applicant has no pending criminal antecedents and is languishing in jail since 11.04.2025 and there is nothing on record to demonstrate that the applicant if enlarged on bail, would in any way adversely affect the trial, I am of the view that the applicant is entitled to be released on bail. Accordingly, the bail application is allowed. 8. Accordingly, the bail application is allowed. 8. Let the applicant Ram Milan be released on bail in the abovesaid first information report number on his furnishing personal bonds and two reliable sureties of Rs.20,000/- each to the satisfaction of the court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which he is accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
