HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 858 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. In the prosecution case, it is alleged that Manju Devi lodged an FIR stating that the accused, Renu Rawat, had called her son Ankit Kumar to Khurdahi, taken him to an unidentified room, and thereafter tied his hands and legs before assaulting him, resulting in approximately 28 injuries. It is further alleged that when the complainant attempted to contact her son later that night, his phone was found switched off, and on the following morning she was informed about the assault. Learned counsel for the applicant submits that although the victim, in his statement under Section 161 Cr.P.C., supported the prosecution version and attributed several knife injuries on his throat to the applicant, he has subsequently turned hostile from the very outset during his examination-in- chief. It is further pointed out that no other prosecution witness has seen the incident. The applicant is in judicial custody since 14.06.2024, is a woman, and it is stated that she and the victim’s son had mutually agreed to marry. The applicant also undertakes to cooperate in the investigation. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Versus Counsel for Applicant(s) : Umesh Singh Lodhi, Durga Prasad Shukla, Himadri Goswami, Kapil Kumar Yadav, Piyush Pathak Counsel for Opposite Party(s) : G.A. Renu Rawat .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s) Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Upon due consideration of the injury report of the victim, which does not align with the prosecution story and PW-2 has turned hostile during examination-in-chief, coupled with the absence of any likelihood of tampering with prosecution evidence, and the fact that the applicant is in jail since 14.06.2024 without any criminal antecedents, I am of the view that the applicant deserves to be released on bail. Accordingly, the bail application is allowed. Let the applicant Renu Rawat, involved in Case Crime No. 295/2024, U/S- 342, 323, 324, 307 I.P.C., Police Station-Shushant Golf City, District- Lucknow, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial. November 19, 2025 R.C.
