By this revision petition, the petitioner has challenged the legality and correctness of the impugned order dated 14.10.2025 passed in MCA No.26 of 2025 by the Court of the learned Additional Judge, District Council Court, Shillong.
The prime contention raised in the revision petition is that the 2025:MLHC:1092
learned Court below passed the impugned order mechanically without applying its mind and also without recording any reason for passing such
order.
The learned counsels appearing for the respondents, in their usual frankness submit that the matter can be sent back to the Court of the learned Additional Judge for fresh consideration after hearing both the parties.
In view of the submission made by the parties, this revision petition is disposed of by setting aside the impugned order dated
14.10.2025. The matter is remitted back to the Court of the learned Additional Judge, District Council Court, Shillong for consideration of the interim prayer in MCA No.26 of 2025 afresh after affording opportunity to the rival parties. As the matter pertains to land dispute, the learned Court shall make an endeavour to hear and dispose of the prayer made for interim relief at the earliest.
With the above, this revision petition stands disposed of.
