HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6375 of 2025 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri. Ankit Dubey, the learned counsel for the petitioner, Shri Devendra Mohan Shukla.
2. By means of the instant petition filed under Article 227 of the Constitution of India, the petitioner has sought issuance of a direction to the Civil Judge (Junior Division) Kadipur, Sultanpur for expeditious disposal of Execution Case No. 02/2023 (Arvind Kumar Vs. Sharda Devi).
3. A perusal of the copy of order sheet of the execution proceedings indicates that on 23.03.2023, the executing court had ordered issuance of notice to the judgment debtor but the order sheet does not reflect as to whether notice has been served on the judgment debtor. Apparently, the judgment debtor has not put in appearance before the executing court.
4. In these circumstances, no direction can be given to the executing court for expeditious disposal of the execution proceedings at this stage.
4. In view of the above, the writ petition is dismissed at this stage. November 6, 2025 Preeti Versus Counsel for Petitioner(s) : Ankit Dubey Counsel for Respondent(s) :
