ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief;
“to issue an appropriate writ,
order or direction more particularly one in nature of Writ of Mandamus declaring the inaction of the respondents especially the Respondent No.2 herein in passing any orders for deletion of subject matter land in SyNo.523 admeasuring Ac. 1.69 cents in Kalasamudram Village, Kadiri Mandal, Sri Satya Sai District from the list of Prohibited lands notified under Section 22-A (1)(a) of Registration Act, inspIte there being a comprehensive Report by the Respondent No. 4 as illegal, arbitrary and violative of Article 300-A of the Constitution of India and contrary to Section 7 of A..P Dotted Land (Updating in Re-Settlement Register) Act, 2017 and conseguently direct the respondents to allow the claim of the petitioner and pass such other order or orders.... ”

learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents.
Learned counsel for the petitioner submits that the petitioner herein is the absolute owner and possessor of the land admeasuring Ac. 1.69 cents in Sy.No.523 situated in Kalasamudram Village, Kadiri Mandal, Sri Satya Sai District, having acquired the same by virtue of Gift Settlement deed executed vide Doc.No.2668 of
1959. Since the date of succession, the petitioner has
3. ■ $ been in peaceful possession and enjoyment of the subject land without being any interference or hindrance from any quarter. Later, the petitioner herein obtained there revenue entries/ mutation vide 1-B Khata No.367. While things stood thus, the petitioner herein submitted an application dated 28.07.2022 through mee-seva requesting the respondent authorities to update his name in the re-settlement register in respect of the subject land. On receipt of such application respondent No.4 conducted an enquiry and issued notices in Form VII & VIII on 28.07.2022 and 13.09.2022 respectively and also conducted a Grama Sabha on 22.09.2022 as prescribed under the Andhra Pradesh Dotted Land Act,
2017. Since no objections were received, respondent No.4 submitted a comprehensive report dated 05.05.2023 to the respondent No.2 recommending (a) updating of petitioners settlement register in respect of the subject land; b) deletion of the subject land from the prohibited properties list under Section name in the re- 22-A(1)(a) of the Registration Act, 1908 as the subject land was erroneously included as assigned land. Despite clear finding and recommendations of No.4, respondent No.2 failed to respondent pass any orders for deleting the subject land from the prohibited list under Section 22-A(1)(a) of Registration Act, 1908 or for updating the petitioners name in the re-settlement register under Section 7 of the Act, 2017. Aggrieved by the said action herein filed the present writ petition. as required the petitioner
4. On the other hand, learned Government Pleader for the submits that in view of the comprehensive report dated 05.05.2023 respondents submitted
by the respondent No.4, the application dated 28.07.2022 submitted by the petitioner would be considered by the respondents, within a reasonable time.
Having regard to the submissions made by the learned counsel for the petitioner and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the respondents, particularly, respondent No.2, to consider and dispose of the application dated 28.07.2022 submitted by the petitioner, taking into consideration the comprehensive report/ recommendation dated respondent No.4, after providing opportunity of hearing to all the parties concerned, in accordance with law, within a period of three (03) months from the date of receipt of a copy of this order. 5. more 05.05.2023 issued by With the above direction, the writ petition is disposed of.
