HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14106 of 2025 Court No. - 18 HON'BLE SHREE PRAKASH SINGH, J. Heard learned counsel for the petitioner and Mr. Varun Pandey, learned counsel for the respondent no.1 and Mr. Ran Vijay Singh, learned counsel for the respondent nos. 2 to 4. A preliminary objection is raised by learned counsel for the respondents that the dispute in question is with respect to recruitment in the Central Government services and, therefore, the said dispute is amenable to the Central Administrative Tribunal as per the provision of Section 14 of the Administrative Tribunals Act, 1985. Learned counsel for the petitioner has tried to refute the aforesaid submission, submitting that in fact, similarly situated candidate has been given appointment and he has been deprived of and, as such, there is violation of fundamental right as the same is against the mandate of Article 14 of the Constitution of India. Considering the submissions of the learned counsel for the parties, it is undisputed fact between the parties that the recruitment was for some post in the Central Government services. Contention of the learned counsel for the parties is that fundamental right of the petitioner has been violated though the appointment in any services is on the strength of the statutory provisions and, therefore, the same would not attract in the present matter. So far as the efficacious statutory remedy is concerned, the same is apparently available Versus Counsel for Petitioner(s) : Abhinav Srivastava, Priyanshu Shukla Counsel for Respondent(s) : A.S.G.I., Ran Vijay Singh, Trideep Narayan Pandey Satyam Bajpayee .....Petitioner(s) Union Of India Thru. Secy. Deptt. Labour Employment Govt. India And 3 Others .....Respondent(s) to the present petitioner and, therefore, the preliminary objection raised by the learned counsel for the respondent; sustains. Consequently, this writ petition is hereby dismissed with liberty to the petitioner to pursue the appropriate remedy before the appropriate forum.
