1. The limited grievance in the present petition is to a direction to the learned trial Court to conclude the criminal trial of Criminal Complaint Case No. 13094 of 2022, pending before the learned Special Railway Magistrate, Raipur expeditiously and to conclude the same within a reasonable time framed.

Learned counsel appearing for the petitioners would submit that the petitioners are the accused persons in the Criminal Complaint Case No. 13094 of 2022 filed by the respondent before the learned Special Railway Magistrate, Raipur for the offences under Section 3(A) of the Railway Property (Unlawful Possession) Act, 1966 (in short ‘RP(UP) Act’). The respondent has filed a complaint on 11-01-2022, but till date the trial of the case has not been concluded. During the pendency of the present criminal case, the petitioners have been terminated from their service and therefore the learned trial Court may be directed to conclude the trial as early as possible within a reasonable time framed.

Learned counsel for the respondent/Union of India has no objection if any direction is being given to the learned trial Court for expeditious disposal of the criminal case pending before it.

Considering the submissions made by learned counsel for the parties and also from the perusal of the order sheets annexed with the petition, it transpires that the Criminal Complaint Case No. 13094 of 2022 is pending since 11-01-2022 and till date there is no considerable progress in the trial of the case. Therefore, it would be
3 appropriate to direct the learned trial Court to conclude the trial of the case as early as possible, preferably within a period of 6 months.
5. In view of the above, the learned trial Court is directed to make all endeavours to conclude the trial of the Complaint Case No. 13094 of 2022 as early as possible, preferably within a period of 6 months from the next date fixed before it.
6. A copy of this order be forwarded to the learned trial Court for compliance and necessary action.
