Heard Mr. S. Muktar, learned counsel for the petitioners. After hearing Mr. Muktar, learned counsel for the petitioners at some length, Mr. Muktar has submitted that the petitioners want to exhaust the remedy of being heard given in the first proviso to sub-section [1] of Section 223 of Bharatiya Nagarik Suraksha Sanhita [BNSS], 2023 before the Court where the Complaint Case no. 551C/2024 is pending. In view of such submission made by the learned counsel for the petitioners, this criminal petition is closed, reserving the liberty to the petitioners to exhaust the remedy of being heard provided in first proviso to sub-section [1] of Section 223 of BNSS, 2023 before the Court of Judicial Magistrate, First Class, Kamrup [M] at Guwahati, in response to the notice issued to the petitioner by order dated 09.07.2025.
