Order 24/07/2025
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0297/2024 registered at Police Station-Khandhar, District- Sawai Madhopur for offences under Sections 115(2), 126(2), 189(2), 333, 351(2), 352 of BNS.
2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The testimonies of the injured-Prem Singh as well as the Medical Officer have been recorded. It is evident from the Medical report that out of the six injuries, five are simple in nature though one injury is grievous in nature caused by sharp weapon but that too on the face of the injured-Prem Singh. He further submits that the incident took
[2025:RJ-JP:27834] (2 of 2) [CRLMB-5754/2025] place on 08.11.2024 and the medical examination was held on 16.11.2024 while the opinion about the injury being dangerous to life was taken on 07.02.2025. He further submits that co-accused- Dilkhush @ Dillu, Vijay Singh, Shankar, Surgyan have already been enlarged on bail by a Co-ordinate Bench of this Court. He again submits that the petitioner is behind the Bars since 26.11.2024 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Ramlakhan @ Lakhan S/o Surgyan shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
