The applicant has filed this application under Section 482 Cr.P.C. with the prayer to quash the charge sheet dated 26/8/2022 and summoning order dated 02.09.2022 as well as non-bailable warrant and 82 crpc order dated 08.05.2025 arising out of Session Case No. 316 of 2022, case crime 80 of 2022 U/S 376, 506 IPC, Police Staition -Gilaula, District Shrawasti, pending before Addl. Session Judge/Spl. Judge POCSO Act Shrawasti contained as Annexure nos. 1& 2. Learned counsel for the applicant submits that he does not want to press this application on merits, however, he submits that he had gone to Mumbai, that is why he could not appear before the court below and N.B.W. has been issued. Learned counsel for the applicant also submits that the applicant will appear before the court below within 2 weeks for recall of Non-Bailable Warrant. In view view of the above, the applicant is directed to appear before the court below within 2 weeks. Thereafter, the court below will take appropriate decision on the application for recall of N.B.W. within 4 weeks thereafter. For a period of 6 weeks or till disposal of the warrant-recall application, execution and operation of the order dated 08.05.2025 arising out of Session Case No. 316 of 2022, case crime 80 of 2022 U/S 376, 506 IPC, Versus Counsel for Applicant(s) : Alok Kumar Yadav, Gyanoday Shukla Counsel for Opposite Party(s) : G.A. Arif Khan .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home U.P. Lko. And Another .....Opposite Party(s) Police Staition -Gilaula, District Shrawasti, shall remain stayed.
