4. Learned counsel for the petitioners has submitted that the petitioners are presently working as Assistant Accountants in the Basic Education Department, except the petitioner no.7 who has been retired on
21.05.2023.
He has further submitted that earlier, the Writ Petition No.7529 of 2023 was instituted wherein, the order was passed on 04.10.2023 with a direction to the respondents to consider the claim of the petitioners and the petitioners' services have been absorbed in the Antarik Lekha Department and now the benefits regarding ACP and next promotion are to be considered by the Antarik Lekha Department. He has further added that even after the Government order dated 25.02.2025 have been issued and subsequent thereof, the letters have also been written by the Finance Controller, Office of Secretary, UP Basic Education, no further proceeding has been undertaken yet. Therefore, submission is that the respondent no.4 may be directed to proceed with, as per the Government order dated 25.02.2025 as well as the letters written by the Finance Controller with respect to the benefit of ACP and the next promotional pay-scale benefits for which the petitioners are entitled in the Antarik Lekha Department. 5. 6. Learned Standing Counsel has submitted that State has already written letter to the Antarik Lekha Department, lastly on 25.09.2025, starting from 25.02.2025. 7. Upon considering the submissions of learned counsel for the parties, it is apparent that the petitioners are working in the UP Basic Education Department though, their services have been merged in the Antarik Lekha Department which is an admitted fact in between the parties.
It is evident from the submission of learned counsel for the respondent no.5 that the State Government as well as the Finance Controller, Office of Secretary, UP Basic Education Department has already written letters to the Antarik Lekha Department regarding the further proceeding as per the absorption of the services in the Antarik Lekha Department. The grievance of the petitioners, at this stage, is that the services of the petitioners have been absorbed in Antarik Lekha Department but the benefits thereof i.e. ACP, seniority and the next promotion are not being considered. 8. Consequently, the respondent no.4, Director, Antarik Lekha Department, Lucknow is directed to proceed in furtherance to the letter dated 25.02.2025 written by the State Government as well as several letters written by the Finance Controller, Office of Secretary, UP Basic Education Department, regarding the claim of the petitioners, in the Antarik Lekha Department, within a period of three months from the date of production of certified copy of this order before him. 9. With the aforesaid observation, the petition stands disposed off. 10. Needless to say that if, there is any shortcoming, the same shall be sorted out, promptly. December 15, 2025 V.
