Heard Mr.Girish Kumar Pandey, learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed challenging Inquiry Report dated 16.04.2024 as well as for a direction to opposite parties to release all retiral dues of petitioner. 3. At the very outset, learned counsel for petitioner submits that he is not pressing prayer - 1 since departmental proceedings were concluded by passing a punishment order. At present, he is emphasizing prayer - 2 in view of the fact that opposite parties, in paragraph - 6 of the counter affidavit, have already admitted the dues required to be paid to the petitioner. From perusal of paragraph - 6 of the counter affidavit dated 17/19.09.2025, the amounts due to the petitioner have been indicated. 4. Learned State Counsel has been provided written instructions dated 03.12.2025 which are taken on record and as per which all amounts indicated in paragraph - 6 of the counter affidavit have already been paid to the petitioner. 5. Learned counsel for petitioner, on the basis of instructions, does not dispute the said fact, but submits that arrears of salary for a period of two years from 10.10.2021 to 19.10.2023 have not yet been Versus Counsel for Petitioner(s) : Girish Kumar Pandey, Sher Bahadur Yadav Counsel for Respondent(s) : C.S.C. Learned State Counsel, on the basis of instructions, submits that with regard to such arrears from 10.10.2021 to 19.10.2023 guidance has been sought from the State Government where it is still pending consideration. 7. In view of the aforesaid facts and circumstances, opposite party No.1, i.e., State of U.P. through Principal Secretary, Department of Finance, U.P. Govt., Civil Secretariat, Lucknow is directed to take a final decision with regard to payment of arrears of salary from 10.10.2021 till 19.10.2023, expeditiously, within a period of six weeks from the date a certified copy of this order is served upon him and in case petitioner is found entitled for the aforesaid amount, actual payment thereof shall be ensured within a period of four weeks thereafter. 8.
