In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Banshihari P.S. Case No.55 of 2025 dated 17.02.2025 under Sections 109/448/467/468/471/506/34 of the Bharatiya Nyaya Sanhita, 2023. And In the matter of: Asraful Hoque & Ors. ….Petitioners. Mr. Imtiaz Ahmed Mr. Mazhar Hossain Chowdhury Ms. Chandrima Debnath
…for the petitioners.
Mrs. Sujata Das Ms. Srilekha Chattopadhyay
…..for State.
Leave is granted to correct the cause title.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are bargadars in the land in question. They are not aware of any illegality that had taken place in respect of the property. In any event, all documents have been seized by the police. There was a delay of five months in lodging the FIR.
Learned counsel appearing on behalf of the State submits that the petitioners were bargadars in respect of some land. They decided to create fake documents to claim ownership for the said land. By falsely representing themselves to be the heirs of the owners of the land, they gifted lands to their respective spouses. Copies of deeds seized in this regard clearly make out this case.
In view of the materials contained in the case diary, I find that this is not a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected.
