BEFORE HONOURABLE MR. JUSTICE PRANJAL DAS ORDER Date : 13-08-2025 Heard Mr. M.M. Zaman, learned counsel for the petitioner. Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor appearing for the State respondent. 2. This is an application under Section 483 of BNSS, 2023 by the petitioner namely, Jahirul Islam, who has been detained behind the bars since 08.07.2025 in connection with Kokrajhar P.S. Case No. 165/2025 registered under Sections 303(2)/317(4)/325 of BNS, 2023 r/w Section 13(i)/16 of the Assam
Page No.# 2/2 Cattle Preservation Act, 2021. 3. Perused the FIR dated 06.07.2025. 4. The allegation in the ejahar giving rise to the case in a very nutshell is about recovery of beef without proper documentation and allegations about suspected involvement in such trade of beef without proper documentation. 5. Learned Additional Public Prosecutor submits that in the meantime, investigation has been completed resulting in charge-sheet against the petitioner being CS No. 152/2025 dated 25.07.2025. Perused the relevant document annexed to the petition. 6. Learned Additional Public Prosecutor submits that the accused may be directed to approach the learned trial Court for bail and opposes the grant of bail to the petitioner at this stage due to filing of charge-sheet. 7. Considering the matter in its entirety, however, I deem it appropriate to allow the accused petitioner to go on bail at this stage, upon completion of investigation. 8.
In such view of the matter, the accused petitioner named above is allowed to go on bail in connection with the aforementioned case on furnishing a bail bond of Rs.20,000/- (Rupees twenty thousand only) with one surety of the like amount to the satisfaction of the concerned Court subject to the following conditions:- i) the petitioner shall not abscond; ii) the petitioner shall not intimidate or harass the informant and family members; iii) shall not try to influence or harass any witnesses; iv) shall not hamper or tamper with the evidence of the case and v) shall not misuse his liberty to commit any offence;
9. Violation of any conditions shall entail cancellation of bail. 10. With the above observation and direction, the bail application stands disposed of. JUDGE Comparing Assistant
