HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10501 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that the victim is a major and a consenting party. In her statement under Section 180 BNSS, the victim has not supported the prosecution case and has stated that she wishes to marry the applicant and live with him. Her radiological age has been assessed as 21–23 years. In her statement under Section 183 BNSS, the victim further stated that she left her home of her own free will with the applicant and intends to solemnize a court marriage with him. She has also clarified that she was never pressured by the applicant. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. On due consideration to the fact that the applicant is 25 years old; the applicant is languishing in jail since 29.08.2025; statements of the victim under Section 180 and 183 BNSS do not inspire confidence; charge sheet has been filed, I find it to be a fit case for enlarging the applicant on bail.
