The petitioner is challenging the proceedings dated 16.08.2013 whereby the Damodaram Sanjivayya National Law University, Visakhapatnam-respondents 1 and 2 [hereinafter referred to as ‘the University’] rejected the request of the petitioner for grant of a time -2- W.P. No.34888 OF 2013 scale in the cadre of the Assistant Librarian/ Deputy Librarian on par with other teaching staff. 2. The petitioner worked as a Library Assistant from 2009 to 2014. He completed post-graduation in M.L.I.Sc. (Master of Library and Information Science) and is, therefore, qualified for the post of Librarian. The petitioner also qualified for the State Level Eligibility Test (S.L.E.T.) in 1997 and was awarded a Ph.D. in Library Science in 2011. 3. The learned counsel for the petitioner submits that though the petitioner worked from 2009 to 2014 with the University as a Library Assistant on a contract basis, as the contract expired, the petitioner thereafter joined A.C. College, Guntur, from 2014 to 2024. It is submitted that the petitioner has now rejoined the University as a technical assistant in the library department. It is further submitted that the petitioner has both educational qualifications and experience to be recruited as a librarian. However, on account of the age restriction in the notification, the petitioner would not be considered for recruitment, considering his advanced age at this point of time. 4. The learned counsel for the petitioner also submits that the petitioner would be entitled for a time scale as the petitioner discharging the same duty as that of any regular Librarian/ technical assistant in the University. -3- W.P. Considering the educational qualification of the petitioner that, the petitioner has completed M.A. (Economics), M.Li.Sc., and qualified S.L.E.T. and also awarded a Ph.D., it is for the respondents to consider the request of the petitioner sympathetically and pass the necessary orders on the representation of the petitioner. 6. The petitioner shall make a representation to the University within four weeks from the date of receipt of the order seeking a grant of time scale. The respondents shall pass necessary orders thereon within six weeks, keeping in view the educational qualification of the petitioner. 7. With these observations, the writ petition is disposed off. No costs. 8. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ JUSTICE HARINATH. N BV
