2025:JHHC:20656 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No.3630 of 2025 ------ Rautu Deogam, aged about 31 years, Son of late Kushnu Deogam, Resident of Village-Kamarhatu, P.O. Chaibasa, P.S., Muffassil, District-West Singhbhum, Chaibasa. … … Petitioner Versus The State of Jharkhand. … … Opposite Party ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Sunil Kumar Upadhyay, Advocate For the State : Mr. S.K. Srivastava, APP Mr. Kamlesh Sharma, I.O. IN PERSON Muffassil, Thana Chaibasa, S/o Late Satyadev Sharma, Address- Village- Satbahini, Thana, Untari Road, Palamu. ----- 04/ 28.07.2025 Heard the learned counsel for the parties. 2. This anticipatory bail application under Sections 482 & 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 419/420/465/467/469/471/472 of IPC. 3. The allegation is that the petitioner while selling his land has furnished some documents including genealogical table under the signature of Village Munda. The Village Munda alleges that he has not signed any document including genealogical table. It is his contention that by forging his signature, the genealogical table was prepared by the petitioner. On the aforesaid allegation the F.I.R. being Chaibasa Muffasil P.S. Case No.123/2023 has been registered. 4. Learned counsel for the petitioner submits that admittedly the land belongs to the petitioner which the petitioner was selling. He submits that he has sold the same by obtaining a proper permission from the authority concerned under Section 46 of the C.N.T. Act. He submits that a similar nature of case was filed at the instance of the Village Munda in which the petitioner has 2025:JHHC:20656 2 been released on anticipatory bail being A.B.A. No.4791 of 2023 on 03.04.2024 by coordinate bench of this Court. 5. Learned APP opposes the prayer for anticipatory bail. 6. The I.O is also present with the case diary. 7. The main contention in this case is that the genealogical table is under the signature of the Village Munda. The village Munda denied his signature and claims that his signature has been forged. On query, the I.O. specifically stated that he has not got the signature of the Village Munda verified with the documents which is alleged to have been created. 8. Since, the I.O. has not verified the signature of the Village Munda with the questionable document and further since the petitioner has obtained permission to sell the land, I am inclined to allow this application. 9. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned C.J.M., West Singhbhum, Chaibasa in connection with Chaibasa Muffasil P.S. Case No.123/2023, subject to the condition that one of the bailers should be a close relative of the petitioner and he should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which they are having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. The petitioner should cooperate with the investigation and appear before the concerned Court once in every fifteen days, till submission of the final report. 10. The presence of the I.O. is dispensed with. (ANANDA SEN, J.) Sandeep. Cp-3
