The present interlocutory application has been filed by the claimant praying for permission to withdraw the awarded amount of Rs.2,88,510/- (Rupees Two Lakh Eighty Eight Thousand Five Hundred Ten) only, which has been deposited by the Insurance Company in pursuance of the
order dated 16.08.2022 passed by this court in IA(C) No. 2434/2022 arising out of MAC Appeal No. 503/2022.
Page No.# 3/3 I have heard Mr. A. Bhattacharyya, learned counsel for the applicant and Mr. N. M. Dutta,
learned counsel representing the Insurance Company. This court, vide order dated 16.08.2022, directed that the operation of the Judgment and Award dated 08.08.2018, passed in MAC Case No. 923/2015, by the learned Member, MACT No. 2, Kamrup (M), Guwahati shall remain stayed subject to deposit of entire awarded amount before the Registry of this Court within a period of three months. It is submitted that the Insurance Company has deposited the entire amount in the Registry of this Court. Therefore, the applicant has prayed for withdrawal of the same. Having heard the learned counsel for both sides, it is directed that the Registry shall release the entire deposited amount of Rs. 2,88,510/- (Rupees Two Lakh Eighty Eight Thousand Five Hundred Ten) only to the applicant upon proper verification and identification. With the above, the present interlocutory application is disposed of.
