Heard learned counsel for the petitioner, learned Standing Counsel for the State and, Shri Mohd. Afzal, learned counsel for the respondent no.4. 2. Present petition has been filed for the following relief: "To, issue a writ, order or direction in the nature of mandamus direct the respondent no.2 to expedite the recovery process of amount recoverable in compliance to the Recovery Certificate dated 27.08.2024 issued by the respondent no.4 in complaint No. NCR144/02/69639/2021 (Rakesh Kumar Vs. Sikka Infrastructure Pvt Ltd.) as arrears of land revenue and direct the respondent no.3 to hand over the possession of the unit to the petitioner, within stipulated period." 3. Petitioner seeks a writ of mandamus upon respondent no. 2 for recovery of Rs. 14,28,064/- from respondent no. 3 pursuant to the order dated 04.07.2024 passed by respondent no. 4. 4. Without entering into the merits, present writ petition is disposed of with a direction upon respondent no. 2 to make best efforts to ensure that necessary recovery is made strictly in accordance with law, as expeditiously as possible, preferably before 31.01.2026, if there is no legal impediment. As for the other relief, we leave it open to the executing authority to proceed strictly in accordance with law without allowing for any undue or long adjournment if there is no legal impediment.
