Mr. Pratikdhar Dwivedi, learned advocate appears on behalf of petitioner and with reference to our earlier order dated 7th October, 2025 submits, respondent no. 3 was to issue instructions. Paragraphs 1 and 2 of said order are reproduced below. "1. Mr. Pratikdhar Dwivedi, learned advocate appears on behalf of petitioner and submits, his client is elected ward member. He is also leader of the opposition in the municipal council of the Nagar Palika Parishad. Prayer of his client is to direct respondent nos. 2 and 3 (respectively the District Magistrate and Nagar Palika) to provide requisite information regarding administration of the municipal council. 2. Mr. Raj Mohan Upadhyay, learned advocate, Additional Chief Standing Counsel appears on behalf of State. Mr. Rakesh Kumar Singh, learned advocate appears on behalf of respondent no. 3 prays for adjournment to obtain instructions." 2. Mr. Shubhranshu Shekhar, learned advocate Additional Chief Standing Counsel appears on behalf of State but none appears on behalf of respondent no. 3, even in revised call. 3. This is a fit case for us to draw adverse inference against respondent no. 3 to effect that it does not have contention to resist prayer of petitioner. Prayers "I" and "II" are reproduced below. "I. A writ, order or direction in the nature of mandamus Versus Counsel for Petitioner(s) : Kapil Dev Dubey, Pratikdhar Dwivedi, Rahul Kumar Counsel for Respondent(s) : C.S.C., Rakesh Kumar Singh Satish Kumar Gupta .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) direct the respondents to decide the representations dated 23.06.2023, 04.04.2024, 27.03.2025 and 06.09.2025 of the petitioner to provide the requisite information and copy of reports mentioned in the aforesaid representations to the petitioner. II. A writ, order or direction in the nature of mandamus directing the respondents to established the rule of law in the working of Nagar Palika Parishad, Khoda Makahanpur, District- Ghaziabad for the interest of public enlarge." 4. Above prayers are allowed. The information is to be furnished upon petitioner communicating certified copy of this order to respondent no. 3. 5. The writ petition is disposed of.
