SREENIVASA REDDY CRIMINAL PETITION_ NO.4939 0F 2025 ORDER:- The Criminal Petition, under Sections 480 and 483 of the BNSS, is filed on behalf of the petitioners/Accused Nos.1 and 2 to grant bail in connection with Crime No.140 of 2017 of Tuni Rural Police Station, East Godvari District, 2) A case has been registered aga-lnSt the Petitioners and another and police laid charge sheet in the aforesaid crime against them for the offence punishable under Section 8(c) r/w 20(b) (ii) (c) of the NDPS Act, which was taken on file aS SC NDPS No.69 of 2018 on the file of the I Addit'lonal D'lstrict & Sessions Judge, Rajamahendravaram. 3) Brief facts of the case are that, On 16.08.2017 afternoon, on receipt of credible -Information about illegal transportation of Ganja, the Inspector of Police, Tuni Circle, along with his staff, conducted raid at Velampeta Colony, NH 16 Road, Runi Mandal and arrested the Al to A3 who are -ln possession Of 10 KGs of Ganja packed in 5 polythene packets. Under the cover of mediators report, the contraband was seized and accused persons were remanded to judicial custody. €\__L s= .rf3F2} I+ 4) Heard, Perused the record. 5) A perusal of material on record goes to showthatthe Petitioners Were arrested on execution of NBW on 19.03.2024. It is Pertinent tO mention here that earlier they were found in possession of 10 KGs of Ganja and they were arrested and released on bail. When the petitioners failed to attend the court on 23.08.2018, NBWs were issued against them. Thereafter, on execution of NBWs on 19.03.2024 they were arrested and remanded to judicial custody. Learned counsel for the petitioners submits that the Petitioners undertake that,they would attend the Court regularly without fail. It is relevant to mention here that A3 was also absconding and until and unless A3 is apprehended, there is no possibility of commenJcing trial. 6) In view of the facts and circumstances of the case and keeping in view of the fact that the petitioners were arrested on 19.03.2024 and since more than 1 year and three months, they are languishing in jail, this Court is inclined to grant bail to the Petitioners/Accused Nos.1 and 2, on the following stringent conditions. *,`-I` - dei\ rrfs3a|'- (i) The petitioners shall be released on each of them executing a personal bond for Rs.10,OOO/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned I Additional District & Sess-Ions Judge, Rajamahendravaram.
