HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 36709 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J. HON'BLE SWARUPAMA CHATURVEDI, J. 1. Heard Mr. Omar Zamin, learned counsel for the petitioner, Sri Ajay Kumar Gautam, learned panel counsel appearing for respondent nos. 1, 2 and 3 and perused the record. 2. By means of this writ petition filed under Article 226 of the Constitution, petitioner seeks a writ in the nature of mandamus to command respondent no. 2 to consider the application of the petitioner for re-issuance of the passport, which according to him, he has applied for fifth time. 3. It is contended that four times previously, his passport has been renewed and there was no objection ever raised by the respondents, however, when fifth time application was moved, an objection is being raised that previously there was a discrepancy in the date of birth of the petitioner in passport issued to him. It was claimed that his date of birth in previous first three passports that were initially issued, his date of birth was recorded as 20.06.1965 whereas for the fourth time when renewal was granted, it contained date of birth as 20.06.1970. It is further contended that petitioner upon receiving the notice issued by the Regional Passport Officer dated 15.07.2025, had already submitted his reply on 24.09.2025 but till date no action has been taken by respondent no. 2 namely, Regional Passport Officer, Lucknow upon the pending application for re-issuance of passport. 4. Learned panel counsel appearing for respondent nos. 1, 2 and 3 submits that since petitioner has already submitted his reply, the same can be considered by the authority but the petitioner is also required to appear Versus Counsel for Petitioner(s) : Mohd Shah Faisal Rauf, Omar Zamin Counsel for Respondent(s) : A.S.G.I. Tahir Ali .....Petitioner(s) Union Of India And 2 Others .....Respondent(s) before the authority with all his documents so that the authority may record its satisfaction that the person who was granted three times earlier passport was the same person who was granted fourth time also the passport and now he is the same person who is seeking renewal/re-issuance. 5. 5. Having heard the learned counsel for respective parties and having perused the record, we consider it appropriate for the petitioner to now appear before the Regional Passport Officer, Lucknow with all his documents and academic records in support of his date of birth as 20.06.1970 in the passport issued fourth time to the petitioner, on or before 15.11.2025 and in the event petitioner appears as directed, the Regional Passport Officer, Lucknow shall examine the matter and will do the needful by passing a final order upon the pending application for re-issuance of the passport in accordance with law, within a further period of one month. 6. With the aforesaid observations and directions, this petition stands disposed of. October 28, 2025 #Vikram/- WRIC No. 36709 of 2025 2 (Swarupama Chaturvedi,J.) (Ajit Kumar,J.)
