Khalid, learned counsel for the petitioner, Sri Abhishek Shukla, learned Additional Chief Standing Counsel appearing for the State-respondents and Sri M J Akhtar, learned counsel appearing for respondent no.73-Nagar Palika Parishad, Kushinagar. Present petition has been filed seeking a direction to respondent no.2-Sub-Divisioinal Magistrate, Tehsil Kasya, District Kushinagar to decide the restoration application dated 23.6.2025 filed by respondent no.6 in Computerized Case No.202505440400003 (Smt. Sarita Devi vs. Kuldeep and others) under Section 24 of the U P Revenue Code, 2006, within a stipulated period of time. Counsel for the petitioner has referred to the 'order sheet' of the case, a copy whereof has been appended to the writ petition to point out that although several dates have been fixed but for some reason or the other, matter has been adjourned. The delay in disposal of the case is stated to be causing hardship to the petitioner. Accordingly, a prayer is made for a direction to respondent No.2, to decide the aforesaid restoration application at an early date. Having regard to the aforesaid, the present petition is disposed of with an observation that the respondent No.2-Sub-Divisional Magistrate, Tehsil Kasya, District Kushinagar, would make an endeavor to decide the aforesaid restoration application, which is stated to be pending before it, preferably within a period of three months, without granting any unnecessary adjournments to either of the parties, provided there is no other legal impediment.
