And In the matter of: Dilip Murmu @ Naga Murmu & another. ….Applicants/Petitioners. Mr. Shibaji Kumar Das …for the petitioners. Mr. Kausik Biswas Mr. Sobhan Gani ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The elderly father of the petitioner was roughed up by the assailants on the false allegation that he was practicing witchcraft. In the process, a scuffle took place and the other side also received injury. Although the petitioners’ FIR was given to the police earlier, it was registered later. Learned counsel appearing on behalf of the State relies on the two case diaries and submits that while the injury in the first case, which was started against the petitioners, is grievous, the injury report of the counter case, which was started by the present petitioners, shows that the injury is simple in nature. Considering the materials available in the case diary and the roles ascribed to the present petitioners, I am not inclined to grant anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected. (Jay Sengupta, J.)
